Tutor Agreement

By registering as a tutor on NearbyTutor, you agree to the terms set out below. Please read carefully.
1. Independent contractor status
You are an independent contractor, not an employee, agent, or partner of NearbyTutor. Nothing in this agreement creates an employment relationship, partnership, joint venture, agency, or franchise between you and NearbyTutor.
As an independent contractor, you are solely responsible for:
- Payment of your own income tax, professional tax, and GST (if applicable).
- Compliance with applicable Indian laws governing independent contractors and self-employed individuals.
- Obtaining any professional licenses or certifications required to teach your subjects.
- Your own insurance, including professional indemnity if you teach in the student's home.
2. Eligibility to register
To register as a tutor, you must:
- Be at least 18 years old.
- Be a resident of India.
- Hold a valid government-issued photo ID (Aadhaar, Passport, or Voter ID).
- Not be subject to any criminal conviction related to fraud, abuse, or offences involving minors.
- Have genuine subject-matter knowledge in the subjects you list on your profile.
3. Profile accuracy & verification
You agree that all information you provide on your tutor profile is accurate, current, and not misleading. This includes:
- Your name, photo, and contact information.
- Your educational qualifications (degree certificates must be uploaded for verification).
- Years of experience and any claimed certifications.
- Subject expertise and grade levels you are qualified to teach.
- Your availability and teaching modes (home visit, online, centre, group class).
NearbyTutor reserves the right to request additional verification documents at any time. Submitting false credentials is grounds for immediate permanent suspension and may be reported to relevant authorities.
4. Conduct & professionalism
You agree to:
- Conduct sessions in a safe, respectful, and professional manner.
- Arrive on time or connect punctually for online sessions.
- Notify the student with adequate notice (at least 2 hours) if you must cancel.
- Not engage in any form of physical, verbal, or psychological abuse toward students.
- Maintain appropriate boundaries at all times, especially when teaching minors.
- Not share student contact information with third parties.
- Not use the platform to promote competing tutoring services or solicit students for off-platform arrangements.
5. Credit bypass and direct matches
Tutors must use the Nearby Credits system to connect with students. Sharing contact information in public bio/profile fields (email, phone number, social links) to bypass credit requirements is strictly prohibited. Doing so will result in immediate profile suspension.
Once a match is accepted and contact details are unlocked, all tutoring sessions, scheduling, and payments are conducted directly off-platform between the tutor and the student/parent. NearbyTutor is not a party to these sessions and holds no liability.
6. Direct tutoring payments & tax compliance
Direct payments: Tutors set their own rates and collect payments directly from students/parents. NearbyTutor does not collect tutoring fees, charge a commission on lessons, or process payouts.
Nearby Credits: Tutors purchase Nearby Credit packages from NearbyTutor to accept student matching requests. Nearby Credit purchases are governed by our Refund & Cancellation Policy.
Tax responsibility: As an independent contractor, you are solely responsible for declaring your earnings, registering for GST if you exceed the statutory threshold, and paying all applicable local and national taxes directly. NearbyTutor does not deduct TDS or manage tax filing for your teaching income.
7. Scheduling & cancellations
All scheduling and cancellation terms must be negotiated directly between you and the parent/student. NearbyTutor does not manage class timetables or resolve scheduling disputes. We encourage tutors to establish clear, written cancellation guidelines with families before starting lessons.
8. Reviews & reputation
Students and parents may leave a rating and review once the tutor accepts the request. You may not:
- Offer incentives (money, free sessions, gifts) in exchange for positive reviews.
- Threaten or pressurise students or parents to change or remove negative reviews.
- Create fake student accounts to leave reviews on your own profile.
NearbyTutor monitors review patterns and removes fraudulent reviews. Tutors found to be manipulating reviews will be permanently banned.
9. Intellectual property and profile content
When you teach, any materials, notes, worksheets, or lessons you share with students during your tutoring sessions belong entirely to you. NearbyTutor does not claim any ownership over your teaching materials.
When you upload photos, videos, bio texts, qualifications, or other content to your public NearbyTutor profile, you grant us a simple, cost-free, worldwide license so we can show and display your profile on NearbyTutor, and promote it in our marketing materials (so students can find you). We will always attribute your profile content to you. You can update or remove your profile information at any time.
10. Identity & document verification
NearbyTutor conducts basic document verification (valid government photo ID like Aadhaar, and degree certificates) to confirm the profiles on the platform. However, NearbyTutor does not perform police verification, forensic vetting, or criminal background checks.
Students and parents are advised to conduct their own safety checks. You agree to cooperate in good faith with document verification requests. Providing fraudulent documents is grounds for immediate ban and potential legal action.
11. Suspension & termination
NearbyTutor may suspend or terminate your account at any time for:
- Violation of any term of this agreement.
- Complaints from students, parents, or other tutors.
- Fraudulent activity or misrepresentation.
- Conduct that brings the platform into disrepute.
- Extended inactivity (no activity for 12+ months).
NearbyTutor does not hold, manage, or process any lesson payments or tutor earnings. All financial transactions occur directly between you and the student/parent, and NearbyTutor has no responsibility or liability for payouts, refunds, or payment disputes.
12. Independent relationship and liability limit
NearbyTutor is a listing directory that connects tutors with students. Because we do not participate in actual tutoring sessions, we cannot be responsible for the results of the tutoring, grades, or the personal conduct of students and tutors.
You agree that you are fully responsible for your safety and actions during all tutoring sessions (whether online, at home, or in a study center). You agree to keep NearbyTutor, its founders, and staff free from any blame, legal claims, losses, or costs that might arise from your tutoring sessions, behavior, or interactions with students and parents.
13. Governing law and dispute resolution
This agreement is governed by the laws of India. Tutors and students are solely responsible for resolving any disputes, misunderstandings, or issues that arise between them. NearbyTutor has no obligation, liability, or role in mediating or resolving disputes between users.
