1. Acceptance of terms
By accessing or using NearbyTutor ("the platform"), you agree to be bound by these Terms of Service. If you do not agree, do not use the platform.
2. Eligibility
You must be at least 18 years old to register an account. Students under 18 must be registered by a parent or guardian. Tutors must be Indian residents with valid government-issued ID.
3. Tutor responsibilities
Tutors are independent service providers, not employees, agents, or contractors of NearbyTutor. Tutors are solely responsible for their credentials, background check verification, teaching quality, safety compliance, and direct delivery of lessons. Tutors must maintain professional conduct and conduct sessions in a safe environment.
4. Student & parent responsibilities
Students and parents are solely responsible for verifying the qualifications and safety of tutors before hiring them. Parents must supervise home-visit sessions for minors. Students and parents agree to pay tutors directly according to the rates and terms agreed upon between them, and to provide honest reviews based on actual experiences.
5. Payments
NearbyTutor does not handle or process lesson payments, and takes 0% commission on tutoring sessions. All payments for sessions are made directly to the tutor off-platform. NearbyTutor only charges for Nearby Credits used to initiate contact. Users are responsible for their own tax compliance on direct payments.
6. Cancellations & session refunds
Scheduling, cancellations, and refunds for tutoring sessions must be negotiated and resolved directly between the tutor and the student/parent. NearbyTutor has no control over, and is not responsible or liable for, any tutoring session payments or disputes. Nearby Credit package refunds are governed by our Refund Policy.
7. Prohibited conduct
You may not: circumvent the Nearby Credits connection system; post false or misleading profile information; harass or endanger other users; or use the platform for any illegal purpose.
8. Termination
NearbyTutor reserves the right to suspend or terminate any account that violates these terms or guidelines, at our sole discretion, without prior notice.
9. Limitation of liability & disclaimer
NearbyTutor operates solely as an intermediary listing platform. We do not verify the forensic background or safety of users and do not guarantee the quality of tutoring. To the maximum extent permitted by law, NearbyTutor, its founders, and administrators shall not be held liable for any direct, indirect, incidental, or consequential damages, fraud, misconduct, injury, or loss arising from any connection, interaction, or tutoring engagement. All users agree to handle disputes directly and hold NearbyTutor entirely harmless.
10. Governing law
These terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the competent courts of India.
